These Terms of Service ("Terms") govern your access to and use of the REPMAX web application and website (the "Service") operated by REPMAX ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using REPMAX, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate and complete information during registration
Maintain the security of your password and account credentials
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

3. Waitlist and Access

Access to the REPMAX application is currently granted on an invite-only basis. Joining the waitlist does not guarantee or entitle you to immediate access. We grant access at our sole discretion and will notify you via email when your account has been approved.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to other users' accounts or data
Interfere with or disrupt the Service's infrastructure or security measures
Use automated scripts, bots, or scrapers to access the Service
Impersonate another person or entity
Upload or transmit malicious code, viruses, or harmful content
Harass, bully, or threaten other users through social features
Reverse engineer, decompile, or disassemble any part of the Service
Use the AI Coach or AI features to generate harmful, inappropriate, or misleading content
Share your account credentials with third parties

5. Subscription and Payments

Free Plan: Basic features are available at no cost. Free plan users are subject to feature limitations as described on our pricing page.

PRO Plan: The PRO subscription provides access to advanced features at the listed price. Subscription details:

Billing occurs weekly at the current rate
A minimum commitment period of 5 weeks applies
After the minimum period, you may cancel at any time
No refunds are provided for partial billing periods
We reserve the right to change pricing with 30 days' notice

6. Intellectual Property

The Service, including its design, code, features, AI models, and content, is owned by REPMAX and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial fitness purposes.

Your Content: You retain ownership of any workout data, profile information, and content you submit to the Service. By submitting content, you grant us a license to use, store, and process it solely for providing and improving the Service.

7. AI-Generated Content

REPMAX uses artificial intelligence to generate workout programs, provide coaching advice, and analyze performance. You acknowledge that:

AI-generated content is for informational purposes and is not a substitute for professional medical or fitness advice
You should consult a healthcare professional before starting any new exercise program
REPMAX is not responsible for injuries or health issues resulting from following AI-generated programs
AI outputs may occasionally contain inaccuracies or be unsuitable for your specific condition

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPMAX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the Settings page.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
